Terms of Service

Please read these terms carefully before using our platform and services.

These Terms of Service constitute a legally binding agreement between you and FIFO Recruitment Pty Ltd. By accessing or using our platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the FIFO Recruitment website located at fiforecruitment.com.au, together with any related mobile applications, services, and tools (collectively, the "Platform"), operated by FIFO Recruitment Pty Ltd ABN 47 628 391 045 ("FIFO Recruitment", "we", "us", or "our").

By registering an account, submitting a job application, posting a vacancy, or otherwise accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific features or services. These Terms apply to all visitors, registered candidates, employer clients, and any other users of the Platform.

If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" refers to both you individually and that entity.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • "Platform" means the FIFO Recruitment website, applications, tools, and services.
  • "Candidate" means any individual who registers with or uses the Platform to seek employment or submit a job application.
  • "Employer" or "Client" means any company, organisation, or individual who uses the Platform to advertise vacancies, search for candidates, or engage FIFO Recruitment's services.
  • "Job Listing" means a vacancy advertisement posted on the Platform by an Employer or by FIFO Recruitment on an Employer's behalf.
  • "Profile" means the account and associated information you create and maintain on the Platform.
  • "Placement" means the successful engagement of a Candidate by an Employer following referral through the Platform or FIFO Recruitment's services.
  • "Content" means any text, images, documents, data, or other material submitted to or made available through the Platform.

3. Platform Access and Account Registration

3.1 Eligibility

You must be at least 18 years of age to create an account or use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and that any information you provide is truthful, accurate, and complete.

3.2 Account Registration

To access certain features of the Platform, you will be required to register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information to keep it accurate, current, and complete.
  • Maintain the security and confidentiality of your password and account credentials.
  • Accept responsibility for all activity that occurs under your account.
  • Notify FIFO Recruitment immediately if you become aware of any unauthorised use of your account.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. FIFO Recruitment will not be liable for any loss or damage arising from your failure to comply with this obligation. You must not share your account credentials with any third party or permit any third party to access the Platform using your credentials.

3.4 Permitted Use

Access to the Platform is granted for lawful purposes only, consistent with these Terms. You agree not to use automated means, including bots, scrapers, or crawlers, to access or collect data from the Platform without our express written consent.

4. Candidate Terms

4.1 Job Applications

As a Candidate, you may submit applications for Job Listings available on the Platform. You acknowledge and agree that:

  • All information provided in your Profile and job applications must be truthful, accurate, and up to date. Misrepresentation of your qualifications, experience, courses, or right to work may result in immediate termination of your account and may constitute a breach of law.
  • Submission of an application does not guarantee an interview, offer of employment, or Placement.
  • FIFO Recruitment acts as a recruiter or intermediary and is not your employer unless expressly stated in a separate written agreement.
  • Your application and Profile information may be shared with Employers and relevant third parties as part of the recruitment process. Please review our Privacy Policy for further details.

4.2 Right to Work

You represent and warrant that you have the legal right to work in Australia (or any other jurisdiction in which you are applying for work). You must hold any licences, tickets, certificates, and work authorisations required for the roles you apply for. FIFO Recruitment reserves the right to verify your credentials and right to work at any time.

4.3 Candidate Conduct

You agree to conduct yourself professionally in all interactions facilitated through the Platform, including communications with FIFO Recruitment staff and Employers. Any conduct that is fraudulent, abusive, discriminatory, or harmful to FIFO Recruitment, its clients, or other users may result in your account being suspended or terminated.

4.4 No Guarantee of Employment

FIFO Recruitment makes no representations or warranties that use of the Platform will result in employment. We do not guarantee the accuracy or currency of Job Listings, and a listing does not represent a formal offer of employment.

5. Employer Terms

5.1 Job Listings

Employers may post Job Listings on the Platform subject to these Terms and any applicable service agreement. All Job Listings must:

  • Accurately describe the role, responsibilities, qualifications, remuneration, and working conditions.
  • Comply with all applicable Australian laws, including the Fair Work Act 2009 (Cth), anti-discrimination legislation, and work health and safety laws.
  • Not contain misleading, deceptive, or discriminatory content.
  • Relate to genuine, bona fide vacancies.

FIFO Recruitment reserves the right to edit, reject, or remove any Job Listing that does not comply with these requirements or that we consider inappropriate, at our sole discretion.

5.2 Use of Candidate Information

Employers who receive candidate information through the Platform must use that information solely for the purposes of evaluating candidates for the specific vacancy in question. Employers must not:

  • Use candidate information for any purpose other than the relevant recruitment process.
  • Share, sell, or disclose candidate information to any third party without the candidate's consent.
  • Retain candidate information longer than is necessary for the recruitment process or as required by law.
  • Contact candidates for purposes unrelated to the vacancy for which they applied.

Employers are independently responsible for compliance with the Privacy Act 1988 (Cth) and all applicable privacy legislation in relation to personal information received through the Platform.

5.3 Anti-Circumvention

Employers agree not to circumvent FIFO Recruitment's recruitment services by engaging, hiring, or contracting with any Candidate introduced through the Platform without using FIFO Recruitment's services and paying applicable fees as agreed. This obligation applies for a period of twelve (12) months from the date of introduction of the Candidate to the Employer, whether directly or indirectly.

5.4 Equal Opportunity

Employers using the Platform agree to conduct recruitment processes in compliance with all applicable anti-discrimination legislation, including the Age Discrimination Act 2004 (Cth), Disability Discrimination Act 1992 (Cth), Racial Discrimination Act 1975 (Cth), and Sex Discrimination Act 1984 (Cth), as well as equivalent state and territory legislation.

6. Content and Conduct

6.1 User-Submitted Content

By submitting any Content to the Platform (including your resume, profile information, job applications, reviews, or messages), you grant FIFO Recruitment a non-exclusive, worldwide, royalty-free licence to use, reproduce, process, and display that Content solely for the purpose of operating and improving the Platform and providing recruitment services.

You represent and warrant that you own or have all necessary rights to the Content you submit, and that your Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

6.2 Prohibited Content and Conduct

You must not use the Platform to post, upload, transmit, or otherwise make available any Content or engage in any conduct that:

  • Is false, misleading, deceptive, or fraudulent.
  • Is unlawful, harmful, abusive, harassing, threatening, defamatory, or otherwise objectionable.
  • Infringes any intellectual property, privacy, or other rights of any person or entity.
  • Contains viruses, malware, or other harmful computer code.
  • Interferes with or disrupts the Platform or servers or networks connected to the Platform.
  • Collects or harvests personal information from other users without their consent.
  • Impersonates any person or entity, or falsely represents your affiliation with a person or entity.
  • Violates any applicable law, regulation, or code of conduct.

7. Intellectual Property

7.1 FIFO Recruitment Intellectual Property

All content, materials, and functionality on the Platform - including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software - are the property of FIFO Recruitment or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use FIFO Recruitment's name, logo, trademarks, or other brand elements without our prior written consent.

7.2 Permitted Use

You may access and use the Platform for your own personal or internal business purposes in accordance with these Terms. You must not reproduce, duplicate, copy, sell, resell, or exploit any part of the Platform or its content without our express written permission.

8. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your personal information as described in our Privacy Policy.

9. Fees and Payment

9.1 Candidate Services

Registering as a Candidate and submitting job applications through the Platform is free of charge. FIFO Recruitment does not charge candidates any fee for access to job listings or for submitting applications.

9.2 Employer Services

Employers may be charged fees for services including job advertising, candidate sourcing, and placement services. Any applicable fees will be set out in a separate service agreement or order form agreed between FIFO Recruitment and the Employer prior to the provision of services.

9.3 Payment Terms

Where fees are applicable, payment terms will be as specified in the relevant service agreement. Invoices are payable within 14 days of issue unless otherwise agreed in writing. Overdue amounts may be subject to interest at the rate specified in the relevant agreement or, if not specified, at the rate prescribed by the Penalty Interest Rates Act 1983 (Vic) (as amended from time to time).

9.4 Placement Fees

Where FIFO Recruitment successfully places a Candidate with an Employer, a placement fee will be payable by the Employer as specified in the relevant service agreement. The placement fee becomes due and payable upon the commencement of the Candidate's employment unless otherwise agreed in writing.

10. Disclaimers

The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, FIFO Recruitment disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Any warranty regarding the accuracy, completeness, or currency of information on the Platform, including Job Listings and candidate profiles.

FIFO Recruitment does not warrant or guarantee the suitability of any Candidate for any role, or the suitability of any Employer or role for any Candidate. All recruitment decisions remain the sole responsibility of the Employer.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FIFO Recruitment and its directors, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Platform or services, even if FIFO Recruitment has been advised of the possibility of such damages.

Where liability cannot be excluded, FIFO Recruitment's total liability to you for any claim arising out of or in connection with these Terms or the Platform will be limited to the greater of:

  • The total amount paid by you to FIFO Recruitment in the 12 months preceding the event giving rise to the claim; or
  • AUD $500.

This limitation of liability applies to the fullest extent permitted by law and is an essential element of the basis of the bargain between you and FIFO Recruitment.

12. Indemnification

You agree to indemnify, defend, and hold harmless FIFO Recruitment and its directors, officers, employees, agents, contractors, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Platform.
  • Your breach of these Terms or any applicable law or regulation.
  • Any Content you submit to the Platform.
  • Your infringement of any rights of a third party.
  • Any misrepresentation made by you in connection with the Platform or recruitment process.

13. Termination

13.1 Termination by You

You may close your account and terminate your use of the Platform at any time by contacting us at info@fiforecruitment.com.au. Termination of your account will not relieve you of any obligations that accrued prior to termination, including any outstanding payment obligations.

13.2 Termination by FIFO Recruitment

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:

  • A breach of these Terms.
  • Conduct that we reasonably consider harmful to FIFO Recruitment, other users, or third parties.
  • Non-payment of fees where applicable.
  • Requests by law enforcement or other government authorities.
  • Cessation of the Platform or any part thereof.

13.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. Clauses of these Terms that by their nature should survive termination will do so, including clauses relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Western Australia, Australia. You and FIFO Recruitment submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia.

14.2 Dispute Resolution

In the event of a dispute arising out of or in connection with these Terms, you agree to first attempt to resolve the dispute by contacting FIFO Recruitment directly at info@fiforecruitment.com.au. We will endeavour to respond to your query within 10 business days and work with you in good faith to reach a resolution.

If the dispute cannot be resolved informally within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre before commencing formal legal proceedings, unless urgent or interim relief is required.

14.3 Class Action Waiver

To the extent permitted by law, you waive any right to commence or participate in any class action or representative proceeding against FIFO Recruitment arising out of or in connection with these Terms or the Platform.

15. Changes to These Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify registered users of material changes by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The most current version will always be available at fiforecruitment.com.au/terms.html.
